Terms of Service

1. Agreement to Terms
By accessing or using the cook.book platform ("Platform"), including our mobile application, website at cookbook.farm, and any related services, you agree to be bound by these Terms of Service ("Terms"). The Platform is operated by Neverstill Developers LLC. If you do not agree to these Terms, you may not access or use the Platform.
2. Description of Service
cook.book is a social food platform that provides the following services:
- Recipe management — create, store, organize, import, and share recipes
- AI-powered tools — AI recipe generation, image generation, smart suggestions, and nutritional analysis
- Social networking — follow other users, share posts, like, comment, and message other members
- Marketplace — discover local restaurants, farms, and food businesses
- Business tools — business account management, menu publishing, and analytics for food businesses
- Reservation system — browse and book reservations at participating businesses
- Ordering — place orders for pickup or delivery from participating businesses
- Meal planning and shopping lists — plan meals and generate ingredient lists
3. User Accounts
To access most features of the Platform, you must create an account. Account authentication is provided through Supabase. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security and confidentiality of your login credentials
- Notify us immediately of any unauthorized access to or use of your account
- Accept responsibility for all activities that occur under your account
- Maintain only one personal account per individual
You must be at least 13 years of age to create an account. If you are under 18, you represent that you have your parent or guardian's consent to use the Platform.
4. Content Ownership and License
You retain full ownership of all content you create, upload, or post on the Platform ("Your Content"), including recipes, photos, posts, comments, and reviews.
By posting Your Content on the Platform, you grant cook.book a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, distribute, and make available Your Content in connection with operating and providing the Platform. This license exists only for as long as Your Content remains on the Platform and terminates when you delete Your Content or your account.
You represent and warrant that you own or have the necessary rights to Your Content and that Your Content does not infringe or violate the rights of any third party.
5. Acceptable Use Policy
You agree not to use the Platform to:
- Harass, bully, threaten, or intimidate other users
- Post spam, unsolicited promotions, or deceptive content
- Upload or share illegal, obscene, or harmful content
- Impersonate any person or entity
- Attempt to gain unauthorized access to Platform systems or other user accounts
- Interfere with or disrupt the Platform's infrastructure or functionality
- Upload malicious code, viruses, or other harmful software
- Scrape, crawl, or use automated means to access the Platform without permission
- Violate the intellectual property rights of others
- Use the Platform for any purpose that violates applicable law
We reserve the right to remove content and suspend or terminate accounts that violate this policy, at our sole discretion.
6. Business Accounts
Users may register business accounts for restaurants, farms, food producers, and other food-related businesses. Business account holders additionally agree to:
- Provide accurate and current business information, including business name, location, and contact details
- Maintain compliance with all applicable local, state, and federal laws, including food safety regulations, health codes, and business licensing requirements
- Ensure that menus, pricing, and product descriptions are accurate and up to date
- Fulfill orders and honor reservations in a timely and professional manner
- Respond to customer inquiries and complaints in good faith
cook.book is not responsible for the quality, safety, legality, or availability of products or services offered by business account holders.
7. Payments and Billing
Payment processing on the Platform is handled by Stripe. By making or receiving payments through the Platform, you also agree to Stripe's terms of service.
Subscription Billing:
- Certain features require a paid subscription, which will be billed on a recurring basis
- Subscriptions auto-renew unless canceled before the end of the current billing period
- You may cancel your subscription at any time; access continues until the end of the paid period
- Prices may change with reasonable notice; existing subscriptions are honored through the current period
Order Payments:
- Payments for food orders are processed at the time of order placement
- Prices displayed are set by the business and may be subject to taxes and fees
- Tips, if offered, go to the business or delivery personnel as indicated
Refunds:
- Subscription refunds are handled on a case-by-case basis; contact support@cookbook.farm
- Order refunds for issues such as missing items, incorrect orders, or quality concerns should be requested within 48 hours of the order
- Refund eligibility is determined based on the circumstances and may involve the business
8. Reservation System
The Platform allows users to make reservations at participating businesses. By using the reservation system:
- You agree to honor your reservations or cancel within the time frame specified by the business
- Repeated no-shows may result in restrictions on your ability to make future reservations
- Businesses set their own cancellation policies, which will be displayed at the time of booking
- cook.book does not guarantee the availability or quality of the dining experience
Businesses that accept reservations through the Platform agree to honor confirmed bookings and to communicate any changes or cancellations to the customer promptly.
9. SMS Reservation Reminders and Waitlist Notices
CookBook (operated by Neverstill Developers LLC) may send transactional SMS reservation reminders only when you opt in via an optional, unchecked-by-default checkbox on the booking form (for example, "Text me reservation reminders"). Providing a phone number alone does not enroll you in SMS. When you separately opt in for waitlist SMS, we may also send waitlist-open notices. This program is for booking-related and waitlist-related messages only — not marketing promotions.

- Reply YES to confirm or NO to cancel the reservation
- Reply STOP to opt out of SMS reservation messages; reply HELP for help (STOP does not cancel your reservation)

- Carriers are not liable for any delayed or undelivered messages
Email marketing consent is optional and collected separately. SMS consent is also optional and is not required to complete a reservation. Opting into transactional reservation SMS does not enroll you in marketing texts.
10. AI-Generated Content
The Platform offers AI-powered features, including recipe generation, image generation, and nutritional suggestions. Regarding AI-generated content:
- AI-generated recipes, images, and suggestions are provided for convenience and inspiration only
- AI output is not guaranteed to be accurate, complete, safe, or suitable for any particular purpose
- AI-generated nutritional information is an estimate and should not be relied upon for medical or dietary decisions
- AI features do not constitute professional culinary, dietary, medical, or nutritional advice
- You are responsible for reviewing and verifying any AI-generated content before use, especially regarding allergens and food safety
cook.book is not liable for any harm, injury, or loss arising from reliance on AI-generated content.
11. Intellectual Property
The Platform, including its design, logos, branding, software, features, and original content, is owned by Neverstill Developers LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on any part of the Platform without our prior written permission.
The cook.book name and logo are trademarks of Neverstill Developers LLC. All third-party trademarks referenced on the Platform are the property of their respective owners.
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. RECIPE INFORMATION, INCLUDING NUTRITIONAL DATA AND AI-GENERATED CONTENT, IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON FOR MEDICAL, DIETARY, OR PROFESSIONAL DECISIONS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEVERSTILL DEVELOPERS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNTS YOU HAVE PAID TO COOK.BOOK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
14. Indemnification
You agree to indemnify, defend, and hold harmless Neverstill Developers LLC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of another party.
15. Termination
We may suspend or terminate your account at any time if you violate these Terms or for any other reason at our discretion, with or without notice.
You may delete your account at any time through the account settings in the app. Upon account deletion:
- Your personal data will be deleted in accordance with our Privacy Policy
- Content you have shared publicly may remain visible if it has been re-shared by others
- Active subscriptions will be canceled at the end of the current billing period
- Any pending orders or reservations should be resolved prior to account deletion
16. Dispute Resolution
Any disputes arising from or relating to these Terms or the Platform shall first be attempted to be resolved through informal negotiation by contacting support@cookbook.farm. If a dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through binding arbitration or small claims court.
17. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and, where appropriate, provide notice through the Platform or by email. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any legal proceedings shall be conducted in the courts located in Florida.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
